Terms of Service

Persons wishing to carry out application procedures on the Cross-Ministerial Research and Development Management System (e-Rad) ("this system") are required to agree to all of the following terms of service. Persons using this system shall be considered to have agreed to the terms of service below Persons may only indicate that they do not agree to the terms if they do not wish to use this system.

Purpose

Article 1

The purpose of these terms of service is to stipulate terms that must be agreed to before using this system operated by Cabinet Office.

Definitions

Article 2

Terms used in these terms of service are defined as follows.

  • a. "Cross-Ministerial Research and Development Management System (e-Rad)" indicates a cross-ministerial system for online processing of processes related to the Competitive Research Funding System and other research and development systems, from application procedures to results reports.
  • b. "System users" indicates the researchers and administrative officers at research institutions who use this system to perform procedures such as applications.
  • c. "Researcher number" indicates a unique number assigned to each researcher.
  • d. "Independent administrative agencies, etc." indicates independent administrative agencies and special corporations.

Application

Article 3

These terms of service shall apply to all system users.

2. The rules for use of this system that have been created along with these terms of services shall be considered part of these terms of service and shall apply to system users as stated above.

3. The rules for use of this system that have been created along with these terms of services shall be made available to system users via this system's portal site (http://www.e-rad.go.jp) ("the portal site").

Responsibilities of System Users

Article 4

System users are responsible for their use of this system and shall use this system at their own discretion. Cabinet Office and the other national administrative organizations and independent administrative agencies, etc. in charge of procedures carried out via this system accept no responsibility of any kind.

2. System users are responsible for preparing all devices required to use this system (including software and means of communication) and all documents required for applications. System users are also responsible for all costs including communication costs required to use this system and other costs involved in the use of this system.

3. System users shall check the processing status of any application procedures that they carry out using the functions provided by this system.

4. System users are responsible for managing the ID and password required to use this system and all responsibilities created by this management.

5. System users shall endeavor to keep the information registered to this system accurate and up to date. If a system user's registered details need to be changed, the system user shall promptly carry out the required procedure.

Copyrights, etc.

Article 5

Unless otherwise specified, Cabinet Office and the other national administrative organizations and independent administrative agencies, etc. in charge of procedures carried out via this system own all copyrights and author's personal rights for all programs and other works (including these terms of service and the guidelines on filling in applications that are posted on the portal site; the same scope shall apply hereinafter) provided to system users by this system, along with all intellectual property rights for the related knowledge, etc.

2. System users shall handle all programs and other works provided by this system according to the terms below when using this system.

  • a. System users shall use this system only for the purposes intended in these terms of service.
  • b. System users shall not duplicate, modify, edit, distribute or engage in other actions of this nature toward this system outside the scope permitted by Cabinet Office and the other national administrative organizations and independent administrative agencies, etc. in charge of procedures carried out via this system.
  • c. System users shall not lend or transfer any part of this system to a third party, nor offer it as collateral, regardless of whether the purpose is for profit.
  • d. System users shall not remove or change copyright or trademark indications posted by Cabinet Office and the other national administrative organizations and independent administrative agencies, etc. in charge of procedures carried out via this system.

Handling of Personal Details and Purpose of Use Thereof

Article 6

Personal details shall be used by this system within the following scope.

  • a. Personal details provided for purposes such as applications shall be provided to national administrative organizations and independent administrative agencies, etc. using this system within the necessary scope for carrying out and managing application procedures on this system. Necessary information shall also be provided to the Cabinet Office for use by the Council for Science, Technology and Innovation for purposes of policy planning, such as appropriate evaluation of nationally funded research and development, and planning of resource allocation policies and effective and efficient general strategies, as well as for the creation of statistics and request for information to users(questionnaire, etc.)for policy-planning.
  • b. Researchers' details shall be used within the researcher's research institution and provided to other research institutions with which the researcher is affiliated.
  • c. Details on the administrative officer of the research institution shall be provided to national administrative organizations and independent administrative agencies, etc. using this system within the necessary scope for carrying out and managing application procedures on this system.

2.  Policies for the handling of personal details shall be stipulated separately.

Availability, Suspensions, etc.

Article 7

This system shall be available 24 hours a day on both working days and holidays.

2. Cabinet Office may limit use of this system by system users in the event of unusually high traffic.

3. Cabinet Office may suspend this system with advance warning on the portal site if one of the following situations is deemed to have occurred. This system may also be suspended without warning in an emergency situation.

  • a. In the event of scheduled maintenance or inspection of a device in this system
  • b. In the event of serious damage to this system by a natural disaster or other emergency
  • c. Other situations in which a suspension of this system is deemed necessary by Cabinet Office

Prohibitions and Restrictions

Article 8

System users shall not engage in any of the following actions when using this system.

  • a. Use of this system for purposes other than application procedures and the other intended purposes of this system.
  • b. Unauthorized access to this system.
  • c. Actions that impede the operation and management of this system.
  • d. Sending of files infected by a virus to this system.
  • e. Falsification of information in items such as applications.
  • f. Unauthorized acquisition or use of researcher numbers, or retention of multiple researcher numbers.
  • g. Actions that are, or are likely to be, in violation of laws, ordinances or public decency.
  • h. Other actions that will, or are likely to, impede operation of this system.

2.  Cabinet Office may terminate or restrict a system user's use of this system without prior warning if it is found or suspected that the system user has engaged in or is intending to engage in the abovementioned actions.

3.  Beyond what is set forth in the preceding paragraph, Cabinet Office may terminate or restrict a system user's use of this system without prior warning if it is found that the system user has not used his or her own ID and password required to use this system for a certain period of time, and that the system utilization has not been recognized.

Registration, Changes and Deletions of Researchers and Research Institutions

Article 9

Researchers affiliated with a research institution shall be registered to this system by the administrative officer at the research institution. Researchers not affiliated with a research institution shall be registered by Cabinet Office. In order to be registered by Cabinet Office, the researcher shall provide Cabinet Office with an application to register for a researcher number and a copy of a document issued by a national or regional public body that provides proof of details such as the researcher's name, date of birth and address.

2. Research institutions shall be registered to this system by Cabinet Office. In order to be registered by Cabinet Office, the research institution shall provide Cabinet Office with documentation such as a certificate of registered matters or an extract of the institution's registration certificate ("certificate of registered matters, etc.") that provides proof of the institution's current situation, unless the institution was established for reasons such as legal reasons. In the event that the registered details need to be changed or deleted, the institution shall promptly submit documentation describing the details of the change or deletion to Cabinet Office.

Uniqueness of Researcher Numbers

Article 10

If a system user is found to have more than one researcher number, the first acquired number acquired (the researcher number in which the last seven digits are lowest) shall be used and the other numbers shall be deleted.

2.  If a system user becomes aware that they are in the abovementioned situation, they shall promptly notify Cabinet Office.

System Requirements

Article 11

System users should operate this system in the system environment recommended on the portal site.

Disclaimer

Article 12

Cabinet Office and the other national administrative organizations and independent administrative agencies, etc. in charge of procedures carried out via this system accept no responsibility for any damages caused to system users or damages caused to third parties by system users as a result of the system user's use of the system.

2. Cabinet Office and the other national administrative organizations and independent administrative agencies, etc. in charge of procedures carried out via this system accept no responsibility for any damages caused to system users or third parties as a result of causes such as suspensions and restrictions of the system or line faults.

3. Cabinet Office and the other national administrative organizations and independent administrative agencies, etc. in charge of procedures carried out via this system accept no responsibility for any damages caused to system users or third parties as a result of unauthorized use of a system user's ID or password by a third party.

Amendments to Terms of Service

Article 13

Cabinet Office may amend these terms of service without prior notification to system users when deemed necessary.

2. In the event that Cabinet Office amends these terms of service, Cabinet Office shall publish a notification about this on the portal site without delay.

3. System users who use this system after the amendment to these terms of service is posted shall be considered to have agreed to the revised terms of service.

Governing Laws and Jurisdiction

Article 14

The Tokyo District Court shall be the first exclusive agreement jurisdictional court for all legal action occurring between Cabinet Office and system users concerning the use of this system.

Supplementary Provisions

Japanese law shall apply to these terms of service.

These terms of service shall be effective from August 13, 2014.

Supplementary Provisions

These terms of service shall be effective from June 5, 2023.
